In most cases, both a buyer's agent and a seller's agent are involved in selling a home. Often, the seller's agent or firm will negotiate an agreement to split their commission with the buyer's agent or firm. Usually, the seller will pay the fee or commission.
Working as a "Dual Agent"
In some cases an agent will represent both the seller and buyer throughout the same transaction. Yes, this sounds a little confusing, but can be legally done! The agent must get written consent from both buyer and seller and must disclose to both buyer and seller that he/she will be working as a dual agent. A dual agent owes his/her fiduciary duties to both the buyer and seller.
*When practicing dual agency in a transaction, the agent may not advise either party about the price, terms, or conditions of the sale other than those available.
